  1. Definitions

 

In these terms and conditions, the following expressions shall have the following meanings:

 

  1. Customer – Refers to you and all other persons who purchase products under your Login.

 

  1. Intellectual Property – Refers to all intellectual property rights of any nature, including (without limitation) patents, designs, present and future trademarks, copyright (whether registered or registrable), and the right to file an application for such registration.

 

  1. Login – Refers to a customer’s membership number and access credentials used to sign into the Superstore platform.

 

  1. Point of Sale – Refers to the time and place where the transaction between the customer and Superstore is completed, and payment is accepted, whether online or in person (subject to the Superstore Payment and Transaction Security Policy)

 

  1. The Point of Delivery- refers to the specific location or method agreed upon where the goods are handed over, or services are rendered, to the customer.

 

  1. Product/Products – Refers to all goods listed for sale on the Superstore platform.

 

  1. Superstore – Refers to Digital Superstore Pte Ltd, the legal entity that owns and operates the Superstore platform and sells products to customers.

 

  1. Superstore Platform – Refers to the Superstore website, mobile app, and any other digital or physical medium used for listing and selling products.

 

  1. Sale – Refers to the legal transfer of ownership of products from Superstore to the customer upon successful transaction completion (subject to the Superstore Payment and Transaction Security Policy).

 

  1. Disclaimer – Refers to a statement that limits Superstore’s liability for certain risks, including but not limited to product availability, delivery conditions, and third-party service failures (subject to the Superstore Disclaimer Policy).

 

  1. Delivery Agent – Refers to Superstore’s logistics personnel or any third-party courier authorized to deliver products.

 

  1. ID- Government Issued Identification such as Fiji Valid Voter ID, Valid Passport & Valid Driving License.

 

  1. Digital Signature – Refers to an electronic acknowledgment provided by the customer or an authorized representative upon delivery of goods (subject to the Superstore Delivery and Redelivery Policy).

 

  1. Representative – Refers to an individual authorized by the customer (18+ years old) to accept delivery on their behalf.

 

  1. Redelivery Fees – Refers to additional charges that may apply if redelivery is required due to customer unavailability or refusal to accept delivery without cause (subject to the Superstore Delivery and Redelivery Policy).

 

  1. Privacy & Data Protection – Refers to Superstore’s obligation to securely collect, store, and handle customer data in compliance with applicable laws (subject to the Superstore Data Storage and Privacy Policy).

 

  1. Refund & Return Process – Refers to Superstore’s policy governing the return of defective, incorrect, or unsatisfactory products and the refund process (subject to the Superstore Returns & Refund Policy).

 

  1. Dispute Resolution – Refers to the formal process customers must follow to raise complaints or disputes related to transactions, deliveries, refunds, or any other Superstore service (subject to the Superstore Dispute Resolution Policy).

 

  1. Placing an Order & Acceptance of Terms

 

  • By placing an order on the Superstore platform, you acknowledge and agree to these terms and policies, subject to updates provided at checkout.
  • Superstore will provide advance notice of any material changes to these terms (subject to the Superstore Account Suspension and Termination Policy).
  • Orders can be placed 24/7, and delivery will be scheduled as per the chosen delivery method (subject to the Superstore Delivery and Redelivery Policy).
  • Superstore is responsible for reasonable efforts to deliver products within the estimated timeframe. If delivery is delayed due to unforeseen circumstances, the customer has the right to seek redelivery or a refund (subject to the Superstore Dispute Resolution Policy).

 

 

 

 

 

  1. Delivery Policy
    • Delivery Locations & Restrictions
      • Superstore delivers only to physical addresses within serviceable areas (subject to the Superstore Delivery and Redelivery Policy).
      • If the Superstore platform does not accept your address, delivery is unavailable due to logistical or legal reasons. Alternative options such as in-store pickup or third-party courier services may be available (subject to the Superstore Dispute Resolution Policy).
      • Estimated delivery times are based on delivery schedules and are subject to weather conditions or other restrictions imposed by local authorities.

 

  • Receiving Delivery & Representative Authorization
    • If you are unavailable, you may authorize a representative to accept delivery on your behalf [ this does not apply to alcohol and tabacco related products].
    • Your representative’s acceptance of the order is binding, and Superstore is not liable for unauthorized acceptance unless fraud is proven (subject to the Superstore Dispute Resolution Policy).
    • The Delivery Agent will require proof of identity(passport, driver’s license, or other government-issued ID) for all items including delivery of age restricted items such as Tobacco or Liquor for verification purpose (subject to the Superstore Age Verification Policy) which can not be assigned to a Third Party.

 

  • Identity Verification & Privacy Protection
    • ID data collected during delivery verification will be securely handled and not stored beyond verification (subject to the Superstore Data Storage and Privacy Policy).
    • If the person receiving the goods cannot provide satisfactory proof of identity or age (for age-restricted goods), Superstore reserves the right to refuse delivery (subject to the Superstore Policy on Sale and Delivery of Tobacco and Alcohol Products).

 

  • Digital Signatures & Dispute Resolution
    • A digital signature is required upon delivery to confirm receipt of goods (subject to the Superstore Delivery and Redelivery Policy).
    • Customers have 24 hours to dispute unauthorized digital signatures (subject to the Superstore Dispute Resolution Policy).

 

  • Refusal of Delivery & Redelivery Fees
    • If delivery is refused due to damaged or incorrect items, Superstore will arrange a replacement at no extra charge (subject to the Superstore Returns & Refund Policy).
    • If redelivery is required due to customer unavailability or refusal without cause, additional delivery fees may apply (subject to the Superstore Delivery and Redelivery Policy).
    • Customers must lodge complaints about non-delivery, late delivery, or incorrect products within 48 hours of the scheduled delivery (subject to the Superstore Dispute Resolution Policy).

 

  1. Returns, Refunds, & Complaints Policy
    • Customers must report defective, incorrect, or damaged products within 48 hours of delivery (subject to the Superstore Returns & Refund Policy).
    • Refunds will be processed according to Superstore’s refund policy and may require proof of purchase and product return (subject to the Superstore Payment and Transaction Security Policy).

 

  1. Payments & Security
    • All transactions are securely processed using industry-standard encryption (subject to the Superstore Payment and Transaction Security Policy).
    • Customer payment details are not stored beyond the transaction period, except where required for fraud prevention (subject to the Superstore Data Storage and Privacy Policy).

 

  1. User Reviews & Content
    • Customers may submit product reviews, which must comply with Superstore’s content guidelines and must not contain false, misleading, or defamatory statements (subject to the Superstore User Generated Content and Review Policy).

 

  1. Third-Party Services & Advertising
    • Superstore may display third-party advertisements or links

 

  1. Account Termination & Dispute Resolution
    • Superstore reserves the right to suspend or terminate customer accounts for violations of these terms (subject to the Superstore Account Suspension and Termination Policy).
    • Customers may dispute account suspension or termination (subject to the Superstore Dispute Resolution Policy).

 

  1. Terms of Use & Registration
    • Precedence of Terms

These Terms and Conditions apply alongside any Superstore store policy. However, in the event of inconsistencies, these terms will apply only to the extent permitted by applicable consumer protection laws in Fiji. (Subject to the Superstore Disclaimer Policy).

 

  • Registration & Customer Information
    • The customer agrees to complete the registration process in accordance with Superstore’s requirements, as stated on the Superstore platform.
    • Customers must provide accurate and up-to-date information, including but not limited to their legal name, address, telephone number, and email address.
    • Superstore will collect and process personal information in accordance with Fiji’s Information Act 2018 and the Superstore Data Storage and Privacy Policy. Customer data will be used solely for order processing, customer support, and fraud prevention. For more details, refer to our Privacy Policy. (Subject to the Superstore Data Storage and Privacy Policy).

 

  1. Eligibility & Right to Refuse Registration
    • Registration is open only to residents of Fiji and there are limitations applicable to products such as alcohol and tobacoo.[Subject to the Alcohol and Tobacco Policy].
    • Superstore reserves the right to refuse or terminate registration for valid reasons, including but not limited to fraudulent activity, violation of Superstore policies, or breach of applicable laws. Any refusal or termination will be conducted in compliance with applicable anti-discrimination and consumer protection laws. (Subject to the Superstore Account Suspension and Termination Policy).
    • Customer Liability & Unauthorized Use
      • The customer is responsible for all transactions made under their login and must keep their login credentials confidential.
      • If unauthorized use occurs, the customer must report it immediately to Superstore.
      • Superstore will not hold the customer liable for fraudulent transactions if the customer promptly reports unauthorized access. (Subject to the Superstore Payment and Transaction Security Policy)

 

  1. Order Confirmation & Stock Availability
    • Customers will receive an email confirmation of order receipt, but this does not guarantee stock availability.
    • If an item is unavailable, Superstore will notify the customer and offer a full refund or an alternative product. (Subject to the Superstore Advertising and Product Listing Policy)
    • Security & Unauthorized Access
      • Superstore will take reasonable security measures to protect customer accounts and transactions.
      • If unauthorized access is suspected, customers must report it immediately for investigation.
      • Customers are advised to use strong passwords and enable two-factor authentication where applicable. (Subject to the Superstore Data Storage and Privacy Policy)

 

 

 

 

  1. Delivery, Returns & Refunds
    • Delivery Policy
      • Delivery is available only to serviceable areas in Fiji as indicated on the app platform. If an address is not accepted at checkout, delivery is unavailable for logistical or legal reasons. (Subject to the Superstore Delivery and Redelivery Policy)
      • The customer or an authorized representative must be present to accept the delivery. (Subject to the Superstore Age Verification Policy)
      • For restricted products (e.g., alcohol and tobacco), the recipient must present valid photo ID upon delivery. (Subject to the Superstore Policy on Sale and Delivery of Tobacco and Alcohol Products)
      • Digital signatures are required upon delivery. Customers have 24 hours to dispute unauthorized digital signatures. (Subject to the Superstore Dispute Resolution Policy)

 

  1. Redelivery & Associated Fees
    • If the customer is unavailable at the scheduled delivery time, redelivery fees may apply [Subject to the Superstore Delivery & Re-delivery policy].
    • Customers must lodge complaints about non-delivery, late delivery, or incorrect products within 48 hours of the scheduled delivery. (Subject to the Superstore Delivery and Redelivery Policy)

 

  1. Returns & Refunds
    • Perishable Items

Returns are only accepted if the item is damaged or expired upon delivery.

  • Customers must report any issue within 24 hours of delivery. (Subject to the Superstore Returns & Refund Policy)

 

  1. Non-Perishable Items
    • Returns are accepted within 7 days only if the product is defective or incorrect. (Subject to the Superstore Returns & Refund Policy)

 

  1. Refunds
    • Refunds will be processed in accordance with Superstore’s refund policy.
    • Delivery charges will be refunded only if Superstore is at fault (e.g., incorrect or damaged item sent). (Subject to the Superstore Payment and Transaction Security Policy)

 

  1. Pricing & Billing
    • Pricing Accuracy & Adjustments
      • Superstore will make every effort to ensure that the prices, details, and sizes of products listed on the platform are accurate. However, prices and other details may change without notice, subject to fluctuations in supply and demand.
      • Prices listed on Superstore are for home delivery shopping only. Certain items, especially fresh produce, are subject to daily price fluctuations, and the prices displayed are for guidance purposes only.

 

  1. Product Sizing & Substitutions
    • Not all product sizes will correspond exactly to the description displayed online. If an exact match is unavailable, Superstore reserves the right to provide the closest available size at the nearest price.
    • If a product is out of stock, substituted, or subject to weight-based pricing adjustments, customers will be informed before finalizing the order. Any price adjustments after checkout require customer approval. (Subject to the Superstore Payment and Transaction Security Policy)

 

  1. Billing Adjustments & Final Bill
    • Discrepancies between the online bill and the final bill may arise due to out-of-stock products, substitutions, special offers, daily price changes, or weighed items.
    • Price adjustments will not occur after checkout unless the customer has been notified and expressly agrees to the change. (Subject to the Superstore Dispute Resolution Policy)
    • The final bill, reflecting any approved changes, will be presented to the customer on the app.

 

  1. Promotions & Discounts
    • If multiple promotions apply to the same product, customers may select one promotion at checkout. Promotions cannot be combined unless explicitly stated.

 

  1. Order Variations & Price Changes
    • If a customer requests a variation to their order, Superstore will adjust the price accordingly.
    • Customers will be notified of the new price before the variation is processed, and they must approve the change before finalization. (Subject to the Superstore Payment and Transaction Security Policy)

 

  1. Credit Limits & Reseller Restrictions
    • Superstore may impose credit limits on individual customers based on purchase history and account status.
    • Sales to resellers may be restricted to prevent bulk purchasing that affects product availability for regular customers. (Subject to the Superstore Account Suspension and Termination Policy).

 

  1. Payment & Delivery
    • Payment Methods & Security
      • Payment for products ordered through Superstore can be made via cash on delivery, VISA, MASTERCARD, American Express, Vodafone M-Paisa, Digicel MyCash, and EFTPOS cards issued in Fiji.
      • All transactions are subject to Fiji’s Financial Transactions Reporting Act 2004, ensuring compliance with anti-fraud and financial security regulations.
      • Superstore guarantees secure payment processing for online transactions. In cases of unauthorized or erroneous transactions, Superstore will provide a refund or dispute resolution process in accordance with applicable laws. (Subject to the Superstore Payment and Transaction Security Policy)
    • Changes to Payment Methods
      • Superstore may update its accepted payment methods from time to time.
      • Customers will receive at least 14 days’ notice before any major changes take effect.
      • If a payment method is discontinued, Superstore will offer an alternative method to ensure uninterrupted service.

 

  1. Delivery & Liability
    • Superstore will make every effort to deliver products of acceptable quality to the delivery address specified by the customer within the selected time window.
    • However, delivery delays may occur due to unforeseen circumstances beyond Superstore’s control, such as extreme weather conditions or local authority restrictions.
    • In such cases, customers will be notified as soon as possible, and Superstore will provide the option to:
      • Reschedule the delivery for a later time.
      • Request a refund for undelivered items.

 

  • Superstore remains responsible for delays caused by avoidable factors within its logistics network and will work to minimize disruptions. (Subject to the Superstore Delivery & Returns Policy)

 

  1. Delivery Disputes and Refund Timeframes
    • Right to Dispute Delivery Failures: Customers have the right to dispute failed or late deliveries within 7 days of the scheduled delivery date. To resolve any issues, please contact Superstore customer support.

 

  • Refunds: Refunds for undelivered or late deliveries will be processed within 5 working days, subject to banking or payment provider delays. If additional processing time is required, customers will be notified promptly. Refunds for orders not processed due to system errors or stock unavailability will be issued within 5 working days.

 

  1. Data Security and Privacy
    • Data Retention Period: Superstore retains your personal data securely for up to 12 months after the last transaction, unless required by law to retain it for a longer period. You may request the deletion of your data at any time in accordance with Fiji’s Information Act 2018.

 

  • Security Measures: Superstore employs 128-bit Secure Socket Layer (SSL) encryption and 256-bit Transport Layer Security (TLS) encryption to protect your personal and transaction data. We regularly assess our systems to ensure your data is protected from unauthorized access.

 

  • Fraud Prevention and Customer Login Responsibility
    • Fraud Detection: Superstore uses fraud detection tools to prevent unauthorized account access. Customers are responsible for maintaining the security of their login credentials and should report any unauthorized access immediately.

 

  • Dispute Process: If fraudulent transactions occur, Superstore will investigate and may issue a refund or redelivery, subject to verification. Customers should notify Superstore within 48 hours if they suspect unauthorized access.

 

  • Third-Party Data Sharing and Consent
    • Data Sharing: Superstore will not share your personal data with third parties without your explicit consent. You can manage your data-sharing preferences via your account settings or by contacting customer support.
  1. Digital Signatures and Dispute Resolution
    • Disputes: If you dispute a digital signature confirming delivery, you must notify Superstore within 24 hours. Superstore will investigate the issue, and if fraud is confirmed, we will issue a refund or redelivery at no extra cost.
  2. Refund Policy for Failed Payment Transactions

 

  • Failed Payments: If a payment is successfully processed but the order is not completed due to system errors or stock unavailability, Superstore will issue a full refund within 5 working days. Customers will be notified of any issues impacting their order.

  1. Limitation of Liability
    • General Disclaimer: Superstore strives to provide accurate and up-to-date information on this site. However, we are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of, or inability to use, this site.
    • Service Interruptions: Superstore is not liable for service interruptions, errors, or technical issues beyond its reasonable control (e.g., internet outages, cyberattacks). If a technical failure causes an issue, Superstore will take corrective action, including refunds where necessary.

  1. SUPERSTORE ACCOUNT SUSPENSION & TERMINATION POLICY

  1. Introduction

 

The Superstore Account Suspension & Termination Policy outlines the conditions under which user accounts may be suspended or permanently terminated due to non-compliance with Fiji’s laws, Superstore’s terms of service, and ethical e-commerce practices. This policy aims to ensure the integrity, security, and lawful operation of the Digital Superstore App while protecting customers from fraudulent or unauthorized activities.

 

  1. Grounds for Account Suspension or Termination

 

Superstore reserves the right to suspend or terminate an account under the following circumstances:

 

  1. Fraudulent or Unauthorized Transactions
  • Any attempt to place fraudulent orders using false identities, stolen credit card details, or manipulated payment methods.
  • Use of the platform to bypass legal age restrictions on alcohol or tobacco sales.
  • Any misuse of discount codes, referral programs, or promotions intended to exploit system vulnerabilities.
  1. Non-Compliance with Age-Restricted Product Policies
  • Purchase or attempted purchase of alcohol or tobacco products by an individual under 18 years old.
  • Providing false age verification information or using another individual’s ID to make a restricted purchase.
  1. Multiple Failed Delivery Attempts & Abusive Behavior
  • Repeated failure to accept deliveries without valid reasons, causing operational disruptions.
  • Engaging in abusive, threatening, or inappropriate behavior toward Superstore staff, delivery personnel, or customer service representatives.
  1. Violation of Data Privacy & Security
  • Attempting to access, misuse, or share confidential customer data.
  • Engaging in unauthorized access or hacking attempts against Superstore’s systems.
  1. Misuse of User-Generated Content & Reviews
  • Posting false, defamatory, or misleading reviews about products, sellers, or the platform.
  • Engaging in spamming, fake referrals, or coordinated review manipulation.
  1. Legal or Regulatory Violations
  • Use of the platform for any illegal activities under Fiji’s Liquor Act 2006, Tobacco Control Act 2010, Fijian Competition and Consumer Commission Act 2010, Cybercrime Act 2021, or Data Protection Laws.
  • Attempting to purchase prohibited or restricted goods through deceptive means.

 

  1. Suspension Process

Superstore may temporarily suspend an account when a potential violation is detected. The user will receive a written notification via email detailing:

  1. The reason for suspension.
  1. Any evidence or reports associated with the violation.
  2. Instructions on how to appeal or rectify the issue.
